Uber and Lyft Accidents in NYC

Whose insurance will cover my injuries if I am involved in a ridesharing crash?

Ridesharing apps like Uber and Lyft have become exceedingly popular in recent years, giving taxi cab companies stiff competition throughout New York City. While users appreciate the convenience and low cost of ridesharing services, statistics show a number of ridesharing accidents occur each year. Just recently in Queens, a Lyft passenger was tragically killed when a drunk driver entered the Belt Parkway going the wrong way. Our New York City car accident lawyers discuss liability issues surrounding Uber and Lyft accidents and what you should do if injured in a ridesharing collision below.

Insurance Requirements for Ridesharing Companies

Ridesharing companies in New York and elsewhere across the country require drivers to carry their own personal insurance. However, issues can arise when a driver has solely a personal policy. At times, the insurance company will deny a claim involving an Uber or Lyft passenger because ridesharing constitutes a commercial use. Insurance companies have started to alter their policies to serve ridesharing drivers, by offering personal insurance with added coverage for part-time drivers. Depending on the driver’s policy, there exists a possibility that insurance will not cover the accident.

In addition to the policies held by individual drivers, Uber and Lyft have their own insurance in place. Their policy will only take effect if the driver was logged into the app and carrying a passenger at the time of the accident. Lyft and Uber generally have at least a million-dollar policy, but this policy serves only as the second line of defense when the driver’s policy is exhausted or where the accident victim can prove the ridesharing company was negligent in some manner. Potential instances of negligence include failure to conduct a background check on the driver.

Steps to Take After a Ridesharing Accident

If you have been injured in an accident while riding as a passenger in an Uber or Lyft vehicle, or if your vehicle is hit by a ridesharing car, start by calling local law enforcement officers. You will want to gather as much information as possible, including the driver’s name and insurance information. Take pictures of the accident and contact a personal injury lawyer for assistance with obtaining fair compensation for your injuries.
